Radeon® X850 XT Platinum Edition Contest
CONTEST RULES AND TERMS FOR PARTICIPATION
These contest rules are for the ATI Technologies Inc. ("ATI")” Radeon® X850
XT Platinum Edition Contest (the "Contest"). The Contest
starts on July 26, 2005 at 3:00 PM EST, and ends September 8, 2005
at 10:00
AM EST. Participation constitutes entrants’ full and unconditional
agreement to and acceptance of these rules and terms for participation.
Eligibility
NO PURCHASE IS NECESSARY TO ENTER OR WIN. This Contest
is offered electronically via the Internet to all natural persons who
have Internet access, and are residents of the United States or Canada,
except the Province of Quebec. All Canadian winners must correctly answer
a skill testing mathematical problem, if selected as a winner, in order
to receive a prize. In order to be eligible to receive a prize, winning
entrants must also sign a Declaration and Release form provided by ATI
as described below.
Employees, officers, and directors of ATI, its affiliates, subsidiaries,
advertising, promotion and fulfilment agencies, legal advisors, their
immediate family members and persons living in their same household,
are not eligible to participate in the Contest. ATI's determinations
regarding eligibility are final and binding. VOID WHERE PROHIBITED.
PARTICIPANTS OF MINOR AGE WHO ARE SELECTED AS WINNERS MUST SUBMIT
A DECLARATION AND RELEASE FORM SIGNED BY THEIR PARENT, GUARDIAN PARENT,
OR LEGAL GUARDIAN
CONSENTING TO THE DECLARATION AND RELEASE FORM AND THE TERMS HEREIN
ON MINOR’S BEHALF.
How to Enter
Participants may only enter the Contest by way of
the Internet. To enter the Contest, log onto ATI's Web site at http://buy.ati.com/myprofile/gdc.asp and
complete the Contest entry form. A confirmation that your entry form
has been submitted will be sent by reply e-mail. Odds of winning depend
on the number of eligible entries received.
Only one entry per person or e-mail address is permitted. Entrants
will only be eligible to win 1 prize. If the entry is illegible or
in a format
that is not easily accessible as defined by the ATI Contest officials,
ATI may refuse your submission. ALL ENTRIES SUBMITTED BECOME THE EXCLUSIVE
PROPERTY OF ATI AND PARTICPANT GRANTS ALL RIGHTS IT MAY HAVE THEREIN
TO ATI AND WAIVES ALL MORAL RIGHTS THEREIN.

Prizes
The following Contest prizes will be awarded:
Ten Radeon X850 XT Platinum Edition AGP Bus graphics cards, one per
qualify winner.
No alternative prize, cash, or other substitution is permitted except
by ATI in the event of prize unavailability. Winner should allow up
to 8 weeks for delivery of the prize.
ALL FEDERAL, STATE, PROVINNCIAL, AND/OR LOCAL TAXES/DUTIES ASSOCIATED
WITH THE RECEIPT OR USE OF ANY PRIZE IS THE SOLE RESPONSIBILITY OF
THE WINNER. WINNER AGREES TO PAY ANY APPLICABLE TAXES.
Notification of Winners
ATI Contest officials will process all entries within
30 days of the close of Contest. Winners will be notified by e-mail.
The notification e-mail will state that to claim the prize, the entrant
must submit their mailing address and phone number (P.O. Box addresses
are not eligible to receive a prize) to contests@ati.com within
fifteen (15) days of delivery of the notification e-mail. In the event
of a dispute regarding who submitted an online entry, the entry will
be deemed submitted by the authorized account holder of the e-mail account.
Winner's List
A winner’s list may be posted on the
ati.com web site upon completion of the Contest, as determined by ATI.
Release Form
The winner will be required to sign and return a
Declaration and Release of liability, which includes a declaration of
eligibility, assignment of rights to the entry submitted and a publicity
consent agreement, all within 15 days of receipt by winner, as a condition
of receiving the prize. All Canadian winners must correctly answer a
skill testing mathematical problem, if selected as a winner, in order
to receive a prize. If a selected winner cannot be contacted, is ineligible,
answers the mathematical question incorrectly, fails to provide the complete
address information, fails to claim a prize in the prescribed manner,
or fails to timely return the completed Declaration and Release as is
required, the prize will be forfeited and no alternate winner will be
selected.
Additional Terms and Conditions
All decisions of the judges are final and binding
without appeal. By accepting and/or using the prize, winner agrees to
the use of winner's name, voice, and/or likeness for the purpose of advertising,
trade, or promotion without further compensation.
ATI, agents and representatives of ATI, its affiliates, subsidiaries,
advertising, promotion and fulfilment agencies, and legal advisors
are not responsible for and shall not be liable for: (i) late, lost,
delayed,
damaged, misdirected, incomplete, illegible, unintelligible entries
or unsuccessful efforts to notify winners or their late, lost, misdirected
or unsuccessful acceptance by way of a reply to the notification e-mail;
(ii) telephone, electronic, hardware or software program, network,
Internet,
or computer malfunctions, failures, or difficulties of any kind; (iii)
failed, incomplete, garbled, or delayed computer transmissions; (iv)
any condition caused by events beyond the control of ATI that may cause
the Contest to be disrupted or corrupted; (v) any injuries, losses,
or damages of any kind arising in connection with or as a result of
the
prize, or acceptance, possession, or use of the prize, or from participation
in the Contest; or (vi) any printing or typographical errors in any
materials associated with the Contest.
ATI reserves the right, in its sole discretion, to suspend or cancel
Contest at any time, including but not limited to, if a computer
virus, bug, or other technical problem corrupts the administration,
security,
or proper play of the Contest.
By participating in the Contest, each participant agrees to release
and hold ATI and the employees, officers, directors, shareholders,
agents,
representatives of ATI, its affiliates, subsidiaries, advertising,
promotion, and fulfilment agencies, and legal advisors, harmless
from any and all
losses, damages, rights, claims and actions of any kind in connection
with the Contest or resulting from acceptance, possession, or use
of any prize, including without limitation, personal injury, death,
and
property damage, taxes, levies, duties and claims based on publicity
rights, defamation, or invasion of privacy.
All applicable federal, state, provincial and local laws and regulations
apply.
